Terms of Service

01Acceptance of terms

These Terms of Service ("Terms") are a binding agreement between you and Miksir ("we", "us") governing your use of the Miksir platform — the website, the application, and the four studios: Mix Design, LCA, Geo and BOQ (together, the "Service"). By creating an account or using the Service you accept these Terms. If you use the Service on behalf of a company, you confirm you are authorised to bind that company.

02What the Service is

Miksir is a drafting and calculation workbench for civil-engineering work:

• Mix Design Studio — AI-assisted concrete mix proportioning against published code standards (ACI 211, EN 206, TS 500, BS 8500).
• LCA Studio — life-cycle assessment calculations for any material or product, aligned with ISO 14040/14044, with report generation.
• Geo Studio — geotechnical parameter estimation from SPT/CPT field data using published correlations.
• BOQ Studio — quantity takeoff from structural drawings with a mandatory human-confirmation step, deterministic quantity calculation, and priced bill-of-quantities export.

Quantities, corrections, compliance checks and totals in the Service are computed by deterministic code. AI models are used only to draft — to extract candidate values from drawings, propose inputs, and write narrative text.

03Professional responsibility

You are solely responsible for the professional review of outputs and for compliance with the laws, codes and standards applicable to your project. Miksir is not an engineering firm and does not provide professional engineering services.

04AI processing disclosure

Certain features send your content to third-party AI providers (currently Anthropic) for processing: drawing sheets you upload for BOQ extraction, text inputs used to draft parameters, and study context used to write report narratives. This processing is subject to the provider's data-usage commitments for API customers. Deterministic calculations are performed on our own infrastructure and never by an AI model.

AI-extracted values are always flagged for your confirmation. The Service will not compute a bill of quantities from unconfirmed extracted data.

05Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Seats on Studio and Enterprise plans are per-person and may not be shared between individuals.

06Acceptable use

• Do not upload content you have no right to process — drawings and project data must be yours or licensed to you.
• Do not attempt to disrupt the Service, probe its infrastructure, or access other customers' data.
• Do not resell, sublicense or white-label the Service without a written agreement.
• Do not use the Service to violate export controls or sanctions.

07Subscriptions & billing

• Paid plans (Pro, Studio, Enterprise) are billed through Stripe, monthly or annually, in USD. Prices are listed on the pricing page.
• New Pro subscriptions include a 14-day free trial; no card is required to start a trial.
• Plans renew automatically until cancelled. Cancelling stops future renewals; your plan stays active until the end of the paid period.
• Extraction top-ups (BOQ drawing sheets) are one-time purchases that never expire while your account is active.
• Monthly allowances (mix designs, LCA reports, extraction sheets) reset each billing cycle and do not roll over.
• Customers on the legacy $20/month "Professional" plan retain that price for as long as their subscription remains continuously active ("grandfathering").
• Refunds are governed by the Refund Policy.

08Intellectual property

You retain all rights to the content you upload and to the outputs generated from your inputs. You grant us the limited licence needed to store and process that content to operate the Service. The Service itself — software, design, calculation engines, documentation — remains our property.

09Disclaimers & limitation of liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, and our total liability arising out of the Service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect or consequential damages, or for losses arising from use of outputs that were not professionally reviewed as required by Section 03.

10Termination

You may delete your account at any time. We may suspend or terminate accounts that materially breach these Terms, with notice where practicable. On termination we will make your stored project data available for export for 30 days, then delete it per the Privacy Policy.

11Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be announced by email or in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

12Governing law

These Terms are governed by the laws of [JURISDICTION], and disputes are subject to the exclusive jurisdiction of its courts. (Placeholder — to be set before public launch.)
